Terms of Service

1. Agreement to terms

These Terms of Service (“Terms”) are a legal agreement between you and Strokes & Stakes (“we,” “us,” or “Strokes & Stakes”), an independent service based in Texas, USA. By creating an account, opening the app, or otherwise using the service at strokesandstakes.com, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

2. What the service is

Strokes & Stakes is a web application (also installable as a Progressive Web App) that helps golfers:

• Track scores hole-by-hole in any of 13 supported betting formats (Match Play, Nassau, Skins, Wolf, Sixes, Stableford, Scramble, Best Ball, Snake, Four-Ball, Solo Challenge, Youth Rewards, and Stroke Play).
• Automatically calculate who wins each hole or each segment of a bet.
• Generate a settlement ledger showing who owes whom what at the end of the round.
• Save round history, connect with friends (“buddies”), and compare results over time.

The service is currently provided free of charge. We may introduce paid features or premium tiers in the future, in which case we will give clear advance notice.

3. Wagering disclaimer

This is the most important section of these Terms. Please read it carefully.

• We do not facilitate gambling. Strokes & Stakes is a record-keeping and calculation tool, similar to a paper scorecard. We do not accept, hold, transfer, escrow, process, or pay out any money or thing of value.
• All wagers are between you and your playing partners. Any agreement to wager, and any payment of winnings, happens entirely off-platform, in person or through whatever payment method you and your partners choose.
• You are responsible for the legality of any wager. Laws on social wagering vary by state, province, and country. By using the app to track a wager, you represent that doing so is legal where you are playing and where your playing partners are located.
• We do not verify identity or age for wagering eligibility. It is your responsibility, and the responsibility of your playing partners, to ensure all participants meet local legal requirements.
• The app may be used purely for score tracking without any monetary wager. The “stakes” can be set to any non-monetary value (bragging rights, beers, push-ups, etc.) or simply ignored.

If wagering on a golf round is unlawful in your jurisdiction, do not use the wager-tracking features of the app for any actual wager.

4. Eligibility & accounts

To create an account, you must be at least 13 years old. If you are under the age of majority in your jurisdiction (typically 18 in the United States), you must have a parent or guardian's permission to use the service.

For any feature that involves a monetary wager, you must be old enough under local law to enter into such an arrangement. We make no representation that the wagering features are appropriate or lawful for minors.

Your account

• You agree to provide accurate information when you register and to keep it up to date.
• You are responsible for keeping your password secure and for all activity that occurs under your account.
• You agree to notify us immediately at support@strokesandstakes.com if you suspect unauthorized access.
• One person, one account. You may not create multiple accounts to inflate stats, manipulate leaderboards, or circumvent suspensions.

5. Acceptable use

When using Strokes & Stakes, you agree not to:

• Use the service for any illegal purpose, or in violation of any applicable law or regulation;
• Use the service to operate a commercial gambling, bookmaking, or sports-betting business;
• Harass, threaten, impersonate, or defame any other user, or post offensive or hateful content as a player name, side bet description, or other free-text field;
• Cheat — including entering false scores, colluding to manipulate outcomes, or attempting to defraud another player;
• Attempt to gain unauthorized access to the service, other users' accounts, or our systems;
• Reverse engineer, decompile, or disassemble any part of the service;
• Scrape, crawl, or harvest data from the service except as permitted by our robots.txt;
• Use the service to send spam, phishing emails, or any unsolicited messages via our invitation system;
• Upload or transmit any virus, malware, or other harmful code;
• Interfere with or disrupt the integrity or performance of the service.

We may investigate suspected violations and, in our sole discretion, suspend or terminate accounts that violate these rules.

6. Your content

You retain ownership of the information you enter into the app — your scores, round details, player names, side-bet descriptions, profile bio, and so on (“Your Content”).

By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and transmit Your Content solely as needed to operate and provide the service to you and the players you choose to share with. This license ends when you delete the content or your account, except where we must retain a copy to comply with law or to preserve the integrity of another player's round history.

You represent that Your Content does not infringe any third party's rights and does not violate any law.

7. Our content & intellectual property

The Strokes & Stakes name, logo, app design, source code, written content (including the game-format guides at /games), graphics, and all other materials we create are owned by us and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works of our content without our prior written permission, except as expressly allowed by these Terms or by applicable law (such as fair use).

8. Third-party services

The service relies on third-party providers, including Supabase (database and authentication), Resend (email delivery), Google Analytics (usage analytics), Google Fonts (typography), and the GolfCourse API (course and hole data). See our Privacy Policy for the full list.

We are not responsible for the availability, accuracy, or content of any third-party service. Course data returned by the GolfCourse API may contain errors; you are responsible for verifying course details before relying on them for a wager.

9. Disclaimers

You acknowledge that:

• Score calculations, handicap adjustments, and settlement ledgers are produced by software and may contain errors. You should always verify the final ledger with the other players before settling any wager.
• Push notifications and emails are delivered through third parties and may be delayed, duplicated, or fail to arrive.
• We do not adjudicate disputes between players over scores, agreed-upon stakes, or unpaid wagers. Those are matters between you and your playing partners.

10. Limitation of liability

We are not liable for any loss arising from a disputed wager, an unpaid settlement, or a disagreement between you and another player. Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless Strokes & Stakes and its operator from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or proprietary right; or (d) any wager you enter into using the service.

12. Termination

You may stop using the service at any time and may delete your account from the profile screen.

We may suspend or terminate your access to the service at any time, with or without notice, for any reason — including, without limitation, if we believe you have violated these Terms. Upon termination, the sections of these Terms that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will continue to apply.

13. Governing law & disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws principles.

Informal resolution first

If a dispute arises, you agree to first contact us at support@strokesandstakes.com and try to resolve it informally. We will do the same. We both agree to negotiate in good faith for at least 30 days before pursuing formal legal action.

Venue

If informal resolution fails, you and we agree that any lawsuit arising out of or relating to these Terms or the service shall be brought exclusively in the state or federal courts located in Harris County, Texas. You and we each consent to the personal jurisdiction of those courts.

No class actions

To the extent permitted by law, you and we each agree to resolve disputes only on an individual basis and waive any right to bring or participate in a class action, collective action, or representative action.

14. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top. If the changes are material, we will notify you by email or with an in-app notice before they take effect. Your continued use of the service after an update means you accept the revised Terms. If you do not agree to the revised Terms, you must stop using the service and may delete your account.
